Please carefully read and review these terms and conditions before installing the App on your device or using the Services being offered through it. If you do not agree with these terms and conditions, you may not use the App/Services. We also recommend you review our privacy policy that explains how we collect and handle your personal health information.
Service Description
Health37 is a worldwide platform to promote health by facilitating communication with health care providers (professional health individuals /health entities).
Health37 supports locations, user can find out healthcare providers location on map, and can search for prefer health specialists/entities through the search feature on map. user can visit the provider's timeline, evaluate, communicate with him through Ask me, where he can send text messages and pictures.
Health37 contributes in raising health awareness through health groups which supervised by respected specialists.
our vision is to expand worldwide with several languages to promote health.We do not provide any physicians’ or healthcare providers’ service, but merely facilitate communication between these independent specialists, healthcare providers and the users on the App. All health-related information or advice you may receive on this platform is provided by these healthcare experts and specialists alone, and not from Health37.
We facilitate your interaction with healthcare providers, medical groups, and specialists to promote health awareness in the society. The Services are not intended to substitute your local healthcare provider. Please acknowledge that Health37 is not a party to your patient-physician relationship with the participating healthcare specialists, medical groups, healthcare providers, or healthcare organizations. Health37, any of its subsidiaries, service providers or affiliates, who publish a link to the Services or otherwise promote the Services, shall never be liable for any information being made available on the website, including any professional advice you may obtain from these independent healthcare providers.
We do not endorse or recommend any tests, diagnostics, medications, products, or treatment procedures recommended by your preferred healthcare specialist or other providers/users who may use the Services to communicate with you. You shall rely on any such information or advice at your own risks and discretion.
We may take commercially reasonable measures to verify the professional expertise of participating healthcare providers and specialists, but do not warrant or make any representations regarding the education, training, skill, or experience of any healthcare provider that may connect to you on the App. We may suggest suitable specialists/healthcare providers solely on the basis of your preferences and the information provided by your employer or mentioned in the health insurance plan. You shall be solely responsible for ultimately selecting your healthcare provider.
Agreement
All users and guest visitors on Health37 platform, including specialists, healthcare professionals, and other users on the App shall consent to these terms and conditions for accessing or using the Services. Clicking I Agree, Sign Up, Subscribe, or related syntaxes on any page of this website or interface of your device shall bind you to an agreement with health37, consisting of these terms and conditions.
When you enter this agreement, it shall be deemed that you are legally mature in your jurisdiction and otherwise competent to enter a binding agreement or using the App/Services under the guidance and supervision of your legal guardian who have consented to this agreement. All activities without consenting to this agreement shall be deemed as unauthorized access.
You shall consent or decline this agreement to its entirety. You shall have no rights to redefine these terms and conditions or modify any provisions of this agreement. However, if there is any inconsistency with your additional agreements with the participating healthcare providers and this agreement, the provisions of this agreement shall prevail. In the case of any inconsistency with the applicable laws in your jurisdiction, the impugned sections of this agreement shall remain non-enforceable to the extent of their inconsistency with the applicable laws.
It shall be your responsibility to ensure that you can enter a patient-physician relationship or otherwise use the App/Services in your jurisdiction without violating any local, state, or federal laws or government restrictions for being located in specific jurisdiction or listed in any governmental list of restricted parties/entities.
Health37 reserves a right to determine the process and procedures for using the Services in its sole discretion. We may adapt, modify, restrict, suspend, or permanently discontinue any feature or service being offered on the website/App, without any prior notice or creating any obligations, whatsoever.
Access and Subscription
Browsing the website/App shall be free and voluntary, but you may be required to create and account or subscribe to certain services for connecting with healthcare specialist or other medical groups on this platform. When you register/subscribe on the App, whether to use our premium service or otherwise, you may be required to submit your name, contact number, email address, credit card information, and other details of your personal, professional, demographic, or business profile. Any information that you submit or we may receive from third parties will be handled according to our Privacy Policy which is being incorporated into this agreement by reference.
Your account and use of the Services shall be subject to its approval and consent by Health37. We may refuse, suspend, or terminate your account in our sole discretion and without any obligations, whatsoever. When you submit any information or content on the website/App, it shall be deemed that the information/content is current, complete, accurate, authentic, and up-to-date to your knowledge, and you have all the rights to publish, post, or transmit it. You shall be solely liable for any privacy or copyright violations related to your published, posted, or otherwise transmitted content.
It shall be your responsibility to keep your login information (user ID and Password) secure. All activities under your credentials, including but not limited to any access to restricted areas, purchase of paid subscriptions, modifications to your personal, professional, or business profile, or submission of content on the website shall be deemed to have been done or authorized by you, making you liable for it. If you suspect any unauthorized access or activity under your account, you should promptly report it to our support staff to avoid or minimize your liabilities from any such unauthorized activity.
Appointment booking service
1- For individual , search health care providers , doctors speciality , discounts on map . Allow online booking , edit, delete appointments. Receive notification reminders one day before appointment , and another notification reminder two hours before appointment.
2- For health care providers
It is a paid service for health health care providers as it allows creating a profile for each doctor , up to 100 doctors, containing his picture, speciality , experience, adding working days, clinic duration, lunch period, adding a discount to the beneficiary, booking clinic patients' appointments (offline ) and some other advantages.
Subscription plans for health care providers
The subscription allows health providers to enable appointment booking service by choosing the payment plan , free trial period, 6 months or 12 months. After completing the payment process, a subscription invoice is sent to the subscriber's e-mail, containing the amount paid and the subscription period.
Subscription refund policy
Refund of subscription amount is not possible
Pricing and Payment
Please acknowledge that all prices, exclusive deals and promotional offers on Health37 platform are subject to change at any time and at the sole discretion of the respective medical groups and healthcare providers. The basic services on the App will be free, but Health37 may introduce paid subscriptions to offer certain premium services. These paid subscriptions may be offered on a recurring basis (monthly or yearly), to be automatically renewed at the expiry of its current term unless you make a cancellation request before your subscription renewal date.
Health37 reserves a right to add or remove any payment instrument in its sole discretion. We hold a good faith that you will never use any stolen or unauthorized payment instrument, but we may collaborate with third party payment processors or screening services to verify your transactions on the website/App. Health37 reserves a right to refuse any transaction in its sole discretion.
You shall ensure that you are fully authorize to use your payment instrument and it has sufficient funds to make your transaction or support recurring subscription. Health37 is not responsible for any penalties, fees, or charges imposed by your bank for insufficient funds, over the credit limit authorization or other services.
The participating specialists and healthcare providers shall link a valid bank account or active PayPal subscription to their account on the website/App. Any failure to do so or linking bank account with incomplete/inaccurate details will result in delays or non-payment of sale proceeds. The participating specialists, medical groups, and healthcare providers shall be solely liable to ensure that their linked bank/PayPal account is active and they are fully authorized to receive funds in their linked account.
Subject to any holding period, as determined by Health37, and applicable payment settings/requests, we will transfer the sale proceeds of participating specialists, medical groups, and healthcare providers to their respective linked bank /PayPal account after deducting the applicable service fee. However, we shall not be liable for any holds, confiscations, penalties, charges, or fees imposed by their banks or the government.
Copyrights and Trademarks
The website, App, and its content, including but not limited to its icons, logos, images, graphics, trademarks, service marks, texts, audios, videos, scripts, databases, compilations, services, service names, presentation, titles, interests, and contained intellectual properties are exclusively owned by Health37, protected by the copyright and trademark laws of Saudi Arabia and related international conventions. All proprietary rights otherwise not claimed on the website/App shall belong to Health37. Copyrights © 2018 Health37. All rights reserved. All user generated content on the website, including but not limited to personal, professional, or business profiles, healthcare product or service descriptions, study reports, research papers, or health related information, whether for promoting health awareness or otherwise submitted on the website, shall be deemed as non-confidential public information freely accessible to the users on the website/app. You may access or download any public information on the website/App for personal and non-commercial use.
You will have no rights to edit, alter, counterfeit, remove, or use any framing techniques to enclose any logos, trademarks, service marks, or other proprietary information (texts, images, form, or page layout) from the accessed or downloaded content. You are not allowed to use any meta-tags or other hidden texts for utilizing our service names, trademarks, service marks, logos or deep linking to any content or proprietary information without obtaining our written consent. You should always respect the copyrights, trademarks, or other proprietary rights of Health37 and its collaborating partners who contribute to the Services on the website/App.
Copyright Infringement
Health37 shall have no liabilities for any copyrighted material submitted, uploaded, posted, or otherwise transmitted on/through the website/App. We hold a good faith that the users on the website/App will respect third party copyrights, but if you believe that your work has been used in a manner that constitutes an infringement of your rights, please follow the procedures mentioned in this section to get the infringing content removed from the website/App.
We respect the intellectual property rights of others. Our policies and practices are in compliance with the Digital Millennium Copyright Act (“DMCA”) and related legislations/international conventions. If you are a copyright owner or fully authorized to represent or act on behalf of any copyright owner, you can send a notice of your copyright infringement, complying with the following requirements. Once we receive your notice of copyright infringement, we will restrict the infringing material or activity from the website/App and require the respective user to submit a counter notice within 15 days, failing which the infringing material will be removed permanently.
Prohibited Activities

You shall never deal in human organs or engage in activities that amount to a criminal offense or cause in any kinds of liability to Health37.
You shall never attempt or do anything that amounts to a violation of the security protocols on the website/App. Using any known or unknown technique to increase load on the resources and launch a denial of service attack; circumventing any security requirements, policies, procedures, or regulations for connected networks; accessing or using the Services without proper authorization, in violation of this agreement, or in violation of the applicable laws; and probing, scanning, or testing the vulnerability of any system or network is strictly prohibited. You shall never do anything to interfere or undermine the integrity of devices, computer systems, or networks of other users or gain unauthorized access to their devices or networks.
You are not allowed to use any tools and technologies to access otherwise restricted areas on the website/App, bypass our robot exclusion headers or other security measures, deep-link to any feature or content, or engage in copying, extracting, compiling, or transferring any database, directory, services, application or content that may be required for creating derivative works or launching similar services.
Please acknowledge that any such violation of our system or network security may lead to civil or criminal proceedings. Health37 may monitor your activities on the website/App, but shall have no such obligations, and cooperate with law enforcement authorities or other third parties to investigate/prosecute those who are involved in such violations.
If we believe or become aware at any point that your use of the Services is not in compliance with this agreement or the applicable laws, we may restrict/prevent any further use of the Services or suspend/terminate your account on the website/App. In such cases, we reserve a right to disclose any record, communication, or personal information to the law enforcement agencies or other third parties in our sole discretion.
Healthcare product or Service Listings
The participating healthcare specialists, providers, and organizations may list or promote their healthcare products and services on the platform, but they are not allowed to advertise or promote any product or service which is unhealthy, unscientific, or contains unknown components. Any account or listing that promotes smoking, drinking, cannabis, narcotic drugs or other products or services that are otherwise not related to a healthy lifestyle will be restricted, suspended, or removed from the Services. You are not allowed to list or promote any product, service, or treatment procedure that has been prohibited by the law.
If Health37 believes or becomes aware that any participating healthcare provider, specialist, or healthcare organization has used fabricated professional or business profiles to get listed on the App or involved in unethical or dishonest practices that amount to a material breach of this agreement, it may publish, share, circulate, or disclose such fabricated profiles and/or unethical practices to its collaborating partners, healthcare organizations, and other relevant third parties. Besides being removed or restricted on this platform, such providers may also face restrictions from our collaborating partners as per their terms and conditions.
If Health37 receives any complaints or allegations from other healthcare providers, specialists, healthcare organizations, or third party service providers regarding any kinds of unethical behavior, dishonest/fraudulent activity, or profane language in relation to your use of the Services, whether reasonably suspected or actually committed, we may restrict, suspend, or terminate your account without any obligation to seek your explanation or investigate any further.
User generated Content
All personal, professional, medical, or business profile, including but not limited to your health information, problems, symptoms, conditions, medical history, personal information, professional information, details of offered healthcare products or services, and related consent forms, agreements, views, reviews, comments, requests, videos, images, data, or other materials, whether submitted, uploaded, posted, or otherwise transmitted by the users of the website/App shall be deemed as user generated content. All your questions, concerns, requests, comments, ideas, suggestions, advice, recommendations, or feedback on the website/App (collectively Feedback) shall be deemed as public information, entitling Health37 to disseminate such Feedbacks in any media or manner and use it for its business promotion without any obligations to request your consent, inform, or pay any compensation for intellectual property contained in such Feedback.
When you submit, upload, post or otherwise transmit any user generated content, it shall be deemed that you own the copyrights or fully authorized to do so, and your content is lawful, relevant, accurate, authentic, reliable, complete and updated. You are not allowed to submit, upload, post or transmit any content that contains: Viruses or transmits malicious codes. Misleading, false, inaccurate, fabricated, or deceptive information. Abusive, libelous, unlawful, obscene, threatening, harassing, obscene, offensive, defamatory, objectionable, pornographic, or sexually explicit content. Anything that promotes discrimination or hatred on the basis of race, religion, nationality, ethnic group, sex, or sexual orientation. Anything that promotes nudity, overexposure, or unsolicited sexual behavior. Anything that could encourage criminal/unethical behavior, or induce other users on the website/App to violate the applicable laws, terms and conditions, or the process and procedures for using the Services.
Infringes the copyrights, trademarks, trade secrets, intellectual property, or privacy rights of any person or entity. Subject to the applicable laws, Health37 shall be entitled to adapt, modify, translate, reproduce, create derivative works, display, publish, share, distribute, transmit, or otherwise use the user generated content, in any media or manner, for advertising or promoting its business. You shall ensure that you have all the rights and authority to grant this non-exclusive, perpetual, irrevocable, worldwide, royalty-free, and sub-licensable right to your content on the website/App.
Health37 reserves a right to edit, modify, refuse, or remove any user generated content in its sole discretion. All infringing or potentially infringing content and user submissions that do not comply with this agreement will be deleted from the website/App, in whole or parts thereof, but such corrective measures will take place only when we become aware of any such violations of this agreement. You shall be solely liable for anything you post, submit, transmit, or otherwise make available on the website/App. Health37 shall have no liabilities or responsibilities for any content or information posted, published, or otherwise made available on the website/App by any participating healthcare specialist or provider.
No Medical Advice or Services
Health37 platform promotes health education in the society through independent medical groups being owned and supervised by healthcare specialists. We provide a worldwide network of healthcare professionals, specialists, healthcare organizations, and businesses who deliver their services to the users on the website/App.
Please acknowledge that the Services on the website/App, including but not limited to text s, images, illustrations, graphics, educational materials, study reports, research papers, and other content is being provided for information purpose only, and shall never constitute any kinds of professional diagnosis, treatment, medical advice, or recommendations to cure your health conditions. The Services are not designed or intended to replace your local physician. You should always consult your doctor or seek the advice of a qualified healthcare professional regarding your individual needs, medical conditions or concerns related to your health and well-being.
All communications, whether written or oral, in relation to the Services being offered or made available on the website/App, including but not restricted to the participating specialists, healthcare organizations, and medical groups are intended for health education and general information purposes, and shall never be deemed to create or construed as a physician – patient relationship.
Please acknowledge that the Services on the website/App are not a substitute for professional medical diagnosis and treatment. Health37 only provides a platform where you can communicate and interact with your preferred specialist and healthcare providers. We do not provide any medical services and the doctor-patient relationship is between you and your preferred healthcare provider, who are independent entities and not affiliated with Health37 in any manner.
We take reasonable efforts to verify that information on the website/App, whether provided by Health37, participating specialists, healthcare organizations, or other content providers, is accurate and reliable, but do not claim any such guarantee. You shall use the App/Services at your own risks and discretion.
Indemnity You shall indemnify Health37, its parent, partners, subsidiaries, assignees, affiliates, service providers, and each of their directors, executives, employees, and agents, holding them harmless from all third party claims, damages, liabilities, suits, actions, proceedings, and expenses, including the reasonable legal costs and administrative expenses that may arise in relation to Your use of the Services on the website/App. Your non-compliance with the applicable laws or any defaults, breaches, or violations of these terms and conditions. Your infringement of third party rights on the website/App. . Other expenses incurred by Health37 in relation to your acts and omissions on the website/App, including but not limited to any unauthorized access of the Services under your credentials (using your user ID and password) or use of derogatory, offensive, or otherwise objectionable language or content.
Notwithstanding the foregoing provisions, Health37 shall exercise its legal rights and remedies only after addressing applicable claims with your employer or health plan in all cases where you access/use the Services through your employer or health plan. This section shall survive any termination of your agreement with Health37.

Health37 disclaims all warranties, undertakings, and representations to the maximum extent permissible under the applicable laws. The Services are being offered "as-is" and "as-available" and you shall use it at your own risks and discretion.
We do not endorse, recommend, or renounce any healthcare product or service being made available by any participating healthcare specialist, organization, or business entity. We do not claim or provide any kinds of guarantee, whether express or implied, that you will find suitable specialists or healthcare providers, connect with such professionals, receive price quotes or offers from any particular healthcare provider or resolve your health issues through the Services being offered on the website/App.
No information, advice, reports, suggestions, or recommendations, including but not limited to views, reviews, study reports, research papers, professional expertise or experience of healthcare specialists, excellence in any innovative healthcare technology by the participating healthcare organizations, whether features, published, tendered by support staff, or otherwise made available on this app, shall create any kinds of express or implies warranties or undertakings regarding the accuracy, authenticity, reliability, availability, merchantability, fitness for a particular purpose, or suitability of the Services as per your needs, preferences, or expectations. We hereby disclaim all warranties and undertakings regarding the Services being offered on this website/app.
We do not claim that the Services will be free from errors, omissions, viruses, infringements, or interruptions, and any or all such occurrences will be resolved quickly or promptly. If you are not satisfied, discontinuation of the Services shall be your sole remedy.
Limitation of Liabilities
Health37 shall not be liable for any direct, indirect, incidental, consequential, punitive, special, or other damages, including but not limited to any loss of potential/actual business, revenue, profit, goodwill, credibility, peace of mind, or other tangible/intangible damages that may arise in relation to (1) your ability or inability to use the Services being offered or made available on the website/App, (2) ability or inability to find suitable healthcare specialists, connect with such healthcare professionals/organizations, and/or buy products or obtain their services being featured, advertised, or promoted on the website/App, (3) any damage to person or property related to your use of the Services being offered or made available on the website/App, (4) escalated cost of using another service to search, connect with, or engage healthcare providers, or buy any healthcare product or obtain the services of preferred healthcare specialist, (5) unauthorized access, infringement, or misuse of your personal information on the website/App, (6) activities or statement of healthcare professionals, service providers, healthcare organizations, or other users on the website/App, including their infringement or violation of third party rights or claims by such entities that they are entitled to any kinds of indemnification against asserted rights, claims or demands, (7) any other matter related to your use of the Services on the App, irrespective of the fact that such liabilities occur due to any kinds of errors and omissions, misrepresentations, non-performance, unauthorized access, interruptions, loss of data, torts, or negligence of duty/statutory responsibilities by Health37 or otherwise, and the possibility of such liabilities was already conveyed to it.
These limitations will apply to the extent any such exclusion of incidental or consequential damages is permitted in your jurisdiction. In any case, our total liabilities from any such misrepresentation, non-performance, tort, negligence of statutory duty, breach of contract, restitution, or otherwise, shall never exceed the total amount you paid to obtain any healthcare product or service being offered or made available on the website/App or the maximum amount permitted under the applicable laws governing this agreement, whichever is less.
Notwithstanding the foregoing limitations, your sole remedy for any dissatisfaction with the Services is to stop your access to the website/App and discontinuation of the Services.
Cancellation and Termination
Health37 reserves a right to restrict, suspend, or permanently terminate your account or any subscription to its paid services. You can also cancel your subscription or deactivate your account.
In the case of any material breach of this agreement, the aggrieved party shall send a notice to the other party and the defaulting party shall be liable to correct the breach within 15 days from the day it receives the notice, failing which this agreement shall be deemed as terminated.
Any such termination of this agreement shall have no effect on your pending obligations. If this agreement is terminated, all data, records, profile information, and associated content will be deleted permanently, unless we have any legal, accounting, or reporting obligation to retain our user data.
No claims or compensations shall be admissible on the grounds that your account on the website/App was restricted, suspended, or terminated without giving any prior notice. Force Majeure
Please acknowledge that the Services may be interrupted, disrupted, suspended, or terminated due to technical issues, maintenance requirements, introduction of new features or services, and force majeure events, including but not limited to acts of God, war, invasion, terrorism, network failures, electrical shortages, earthquakes or floods, civil disorder, strikes, fire or other disasters.
Health37 shall not be liable for any interruption of the Services or non-performance of this agreement due to such force majeure events or circumstances that are beyond its reasonable control.

We may publish these advertisement or links to finance the Services and provide research papers, study reports, and other useful information related to the technological innovations in the healthcare industry so that you can make well-informed decisions while using the Services on the App.

Health37 does not have any role or responsibilities regarding third party content and we are not endorsing or recommending any product, service, or content being featured on linked the websites.
Health37 shall not be liable for any claims or liabilities that may arise due to your access to any third party website, reliance on any third party content, or use of any product or service being featured or made available on such websites.
Miscellaneous Provisions
These terms and conditions shall constitute the entire agreement between Health37 and you, including the additional agreements, end-user licenses, privacy policies, and process and procedures pertaining to the subject matter hereof.
If any provision of these terms and conditions is declared null and void by the courts or otherwise becomes unenforceable, the impugned provisions shall be severed to the minimum extent necessary so that the remaining provisions shall continue to be binding and enforceable.
If Health37 is unable to enforce any provision of this agreement or ignores any such non-compliance considering specific circumstances, it shall never be deemed as a waiver of its legal rights and remedies with respect to your subsequent defaults, breaches, non-compliance, or violations of this agreement.
The parties to this agreement, including the participating medical professionals, healthcare providers, healthcare organizations, and other users of Health37 shall be deemed as independent entities and should have no rights to create, assume, or enter any binding agreement or obligations on behalf of the other party.
Health37 shall never be a party to the contractual relationship between the participating medical professionals, healthcare providers, healthcare organizations, and other users of the website/App.
The provisions of these terms and conditions shall be read along with other expressly designated legal notices and terms that may be published on the website/App.
All declarations, notifications, and other communications shall take place through emails, text messages, or other channels of electronic communications, and deemed as written communication to satisfy any legal requirement in your jurisdiction. You agree that all consents and agreements can be signed electronically.
Dispute resolution
The parties to this agreement consent to resolve all their disputes through mutual negotiations. With regard to any such disputes with the participating healthcare providers, specialists, medical groups, or organizations, you shall directly negotiate with the respective providers to work out an amicable solution. However, Health37 may provide a mediation service at its sole discretion.
Applicable laws
The terms and conditions of this agreement shall be governed and construed in accordance with the laws of the Saudi Arabia, without any regard to the conflict of law principles. The parties hereby submit to the exclusive jurisdiction of the competent courts in Saudi Arabia regarding all disputes, claims, or controversies that may not be amicably resolved through mutual negotiation.
Changes and Updates
We may update or replace these terms and conditions at our sole discretion. If this agreement is substantially modified, whether to reflect any changes in the applicable laws, business requirements, or otherwise, we will publish an update on the website, alert you on the App, and send an email notification to your registered email address on the website/App.
